Bill Cosby's lawyers: I DECLARE CONFIDENTIALITY!!!!

I’m sure you’ve heard the rumors. Some woman claims that Bill Cosby raped her 30 years ago. He allegedly gave her a pill and some wine. Did it happen? I dunno. Maybe I just don’t want to believe that Bill Cosby would ever do anything bad to anyone. So for now, I’m in the “anything could be true, but doesn’t sound legit” camp. I would, however, like to take sides against him on one thing, and one thing only. His lawyer’s attempt to claim that a demand letter sent to Buzzfeed is “confidential.” (source) For those of you who are

Adventures in E-Ventures

I have no idea what E-Ventures does. Here’s their website. You figure it out. For all I know, it is the next big thing. I do know that it brought what seems to be a doomed claim. (Complaint) Apparently, Google decided that E-Ventures had behaved a little “spammy.” That seems strange to me, since I can’t recall the last time Google made a decision like that. Nevertheless, Google decided to de-list a bunch of E-Ventures’ websites from its directory. So, now E-Ventures filed a lawsuit over Google’s search results (or lack thereof). I started writing this post when I first

Pick-Up Artist Gets Hilariously Scathing Legal Rebuke

Familiar formula. Jackhole says incredibly offensive stuff under the blanket of the First Amendment. Someone publicly calls him out. He unironically tries to censor his critics. And a lot of times, this works because a threatening letter from a lawyer can intimidate many critics into silence … Read more …

Which came first, the fall of the wall or freedom?

Most people think that first the Berlin wall fell, and then East Germans got their freedom. “The Collapse: The Accidental Opening of the Berlin Wall,” a recent book by Mary Elise Sarotte explains that it is the opposite. Whereas the larger context of perestroika and the attractions of the West played an important role, the decisive factor was the conduct of provincial actors—information smugglers, pastors, artists, students, journalists and housewives who met every week mostly at churches, and slowly undermined the regime. (source) But what made the wall fall? Apparently, Communist Party Official Günter Schabowski did not know how to

Florida First Amendment Counsel Needed (Pro Bono)

I received an inquiry from a party who needs First Amendment counsel in Florida. I have a conflict, so I can’t do it. It is pro bono or perhaps super-duper low bono. It will be fun. (It is representing three individuals against Roca Labs in Broward County) Contact me at mjr at randazza dot com for details if you are interested and licensed in Florida.

I DECLARE CONFIDENTIALITY!

You remember that episode, where Michael Scott declares bankruptcy? [youtube=https://www.youtube.com/watch?v=HuGIgf-ICHM] Keep that in mind for this lesson, kids. This happens to all of us, from time to time. A lawyer sends you a letter with some threatening language on it that he thinks accomplishes his goal of making it “confidential.” You know, like this: CONFIDENTIAL LEGAL NOTICE PUBLICATION OR DISSEMINATION IS PROHIBITED The correct legal response is “suck my ass” or whatever you want to say. Ok, fine, how about “your point is invalid”. Let’s go with that. It is nicer, after all. And I’m all about being nice. Now

The most dangerous car?

This weekend, I was lecturing my kids before they went out to ride bikes. I asked them “what is the most dangerous car?” The answer I was looking for was “a car going in reverse.” My son furrowed his brow, and then his eyes popped! “A POLICE CAR!” I hugged him and said “That is exactly right, you get full points. But also watch out for cars backing out of their driveways.” And isn’t that sad? When I was a kid, we were taught that the police were our friends. In some towns, that might still be the case. And,

I applaud for Google

You all remember SkyNet Google? You know, that little company that could? The one that swore “Don’t Be Evil” and “Make the World a Better Place” were its mantras? Yeah, then they turned into a bunch of evil fucks who would wrap the constitution around the Hulk’s dick and tell it to rape a handicapped child, as long as it increased their stock value? Well, at least they finally made a move in the right direction. They finally admit that maybe they have “outgrown” the “Don’t Be Evil” thing. (source) It is nice to hear them speaking the truth.

Catcalling is for Genetic Refuse

We are here for one reason — to fuck. The old DNA says “spawn or go extinct.” We may have frolics and detours along the way, to either make the rest of our existence more tolerable, or to make the entire group experience more likely to lead to success — and thus more fuckin’. This explains, to me, nature tossing in homosexuality, despite a lack of immediate reproductive benefit to the species. So here we are, guys generally want to fuck anything that moves. Women need to be more selective, because they can only be pregnant by one at a

Lets Play Find the Defamation (updated)

Class, please watch the following video. There will be a quiz afterward. [youtube=https://www.youtube.com/watch?v=6N8z2WIYr4M] [polldaddy poll=8417047] “Potato” is the credited response. Remember, it is not which answer is “correct,” but which is the “best” answer. Nevertheless, science author Paul Brodeur reportedly seeks $1m from the producers of American Hustle for their portrayal of his article in the film. (source). Since I have not seen the complaint yet, I can only base my opinion on the clip and my erudite knowledge of defamation law. I can’t see any such suit being anything more than bullshit. This is a throwaway line by a

The Roca Labs Order

There are plenty of articles out there on Roca Labs. I’ll just provide the order, without comment. Ok, one quote: As Plaintiff has not demonstrated a likelihood of success on the merits of any one of its claims, it is unnecessary to address the other requirements for injunctive relief. (Opinion). Alfonso Ribiero has not made any comment about this. I didn’t ask him either, but just sayin’.

The Candy Bitch

I make no secret about the fact that I do consider open bloody class war to be an ok way to fix things. “Life is like a stew, you have to stir it frequently, or all the scum rises to the top.” I felt that way when I lived off $300 a month, $60 of which was for the rent in a pantry in a place known as the Elmer Phud House. But, back in my Phud days, I had this sneaking suspicion that if I ever managed to be one of the lucky ones one day that I would

Oh…. Candada? Stop trying to be like us!

Dear Canada, You’re already pretty awesome. The weather sucks, but if you ever get around to that Turks and Caicos thing, you can have your own Hawaii. I don’t like to join in when Americans make fun of you. They do that because they don’t know you. (I do admit that I hum “Blame Canada” once and a while, but if you get the joke, that’s not really making fun of you). I’d say I know you pretty well. Remember when we met in 1988? Yeah, the time I went into Foufounes Electrique somewhat bewildered, and left really drunk, then

Thank you again, Rick Scott

I wish I could have had the luxury of growing up and living and spending my entire life in a nice place like the American West, but I was doing other things. As a matter of fact, when I think about it now, the place I lived longest in my adult life was Florida. Back when I lived there, I might have given a shit who became governor. Today, I do not. I just love pointing and laughing at Rick Scott. The guy not only looks like a penis in a suit, but he’s just plain comedy gold. [youtube=https://www.youtube.com/watch?v=MZ3hJH4uQ_c] Watch

Woman Charged Under Revenge Porn Law – Oh, Shocker

I hate the whole revenge porn thing. Not just that people do it, but I hate talking about it. Why? Because the whole subject just attracts bullshit like tourists with fanny packs attract gypsies. One of the biggest sources of bullshit it attracts is the MacKinnonite-Dworkinite “legal scholars.(1) That’s the wing of feminist “thought” that sees everything in terms of “its the girls against the boys, and the boys suck.” They all banded together to make revenge porn a “civil rights” issue, and a gender issue, most inconveniently failing to investigate the facts. They tend to see this as “a

Ebola is the New Black

Ok, not really, but I figured it was a catchier title than “Ebola is the new paranoia for the stupid genetic refuse that proves that Idiocracy was not just a movie, but a prophecy.” That would just not do as a headline. But, I suppose it is a clumsy, but effective lede. Remember “give up ANY rights, as long as it keeps us safe from Beardsley McTurbanhead, who is going to kill us all if he can?” How could you forget? That fad isn’t over yet. But, just in time for the new fall idiot fashion season, we have Ebola!
