
Amicus Brief on Behalf of FIRE in Laurel Libby v. Maine State Legislature

Case Overview
Laurel Libby is a Maine elected representative. She spoke out on a matter of public concern — trans athletes in girls’ sports. We take no position on that, as we take cases both protecting transsexual rights as well as the right to speak out against over-reaching “trans supremacy” as it could be called. However, the Maine legislature has a slim Democrat majority, and that majority chose to censure Laurel Libby by stripping her of the right to vote in the chamber until she engaged in a “struggle session” by apologizing for her views. Whether her views are pro-trans, anti-trans, or otherwise, she has a right to express herself and her constituents have a right to representation.
