McBreairty v. Brewer – Journalist Case

In this case, a government school department sought to censor a journalist’s First Amendment rights by threatening legal action if our client did not bend to their demands.  Our client, Shawn McBreairty, sued for violations of his First Amendment rights.

The case started when some kids at the school were circulating a petition, asking the school to re-think its bathroom policy.  The kids claim that the school then threatened them with a “hate crime” if they did not stop.  The kids reported this to our client, who wrote about the incident.  Shortly thereafter, the school department threatened McBreairty that if he did not remove a photo from his article and statements the government disapproved of, it would subject him to further action.

McBreairty is seeking an injunction from the Court that would permit him to publish without the government interfering.
